Ti chiederanno un parere. Di': “A proposito del defunto che non lascia - sura An-Nisa Versetto 176

﴿يَسْتَفْتُونَكَ قُلِ اللَّهُ يُفْتِيكُمْ فِي الْكَلَالَةِ ۚ إِنِ امْرُؤٌ هَلَكَ لَيْسَ لَهُ وَلَدٌ وَلَهُ أُخْتٌ فَلَهَا نِصْفُ مَا تَرَكَ ۚ وَهُوَ يَرِثُهَا إِن لَّمْ يَكُن لَّهَا وَلَدٌ ۚ فَإِن كَانَتَا اثْنَتَيْنِ فَلَهُمَا الثُّلُثَانِ مِمَّا تَرَكَ ۚ وَإِن كَانُوا إِخْوَةً رِّجَالًا وَنِسَاءً فَلِلذَّكَرِ مِثْلُ حَظِّ الْأُنثَيَيْنِ ۗ يُبَيِّنُ اللَّهُ لَكُمْ أَن تَضِلُّوا ۗ وَاللَّهُ بِكُلِّ شَيْءٍ عَلِيمٌ﴾
[ النساء: 176]

Ti chiederanno un parere. Di': “A proposito del defunto che non lascia eredi, [né ascendenti, né discendenti] Allah vi dice: Se qualcuno muore senza lasciare figli ma ha una sorella, ad essa toccherà la metà dell'eredità, mentre egli erediterebbe da lei tutto quanto se ella non avesse figli; se ci sono due sorelle, avranno i due terzi di quello che lascia; se ci sono due fratelli - maschi o femmine - al maschio la parte di due femmine”. Allah vi illumina affinché non erriate. Allah è l'Onnisciente.

Ti chiedono, o Messaggero, di fornire loro una Fatwa ( regola ) riguardo l`eredità del Kalēleh ( ovvero colui che muore senza lasciare né padre né figlio ); di` loro: " Allāh vi chiarisce ciò con la Sua Legge.
Se muore qualcuno e non lascia né padre né figlio , ma ha una sorella oppure una sorellastra da parte di padre, lei eredita la metà del patrimonio; se ha un fratello oppure un fratellastro, eredita tasiman, se non possiede il diritto di erede; se vi è qualcun altro che ha diritto all`eredità, il precedente eredita ciò che resta.
Se vi sono molte sorelle o sorellastre paterne, due o più, ereditano due terzi, come dovuto; se invece i fratelli oppure fratellastri paterni, maschi o femmine, hanno ereditato Ta`sīb, in seguito alla regola che attribuisce al maschio il corrispettivo che spetta a due donne.
Allāh vi chiarisce la legge sull`eredità, sia per quanto riguarda il Kalēleh che altri, affinché non siate iniqui in tale faccenda; e Allāh è Onnisciente, nulla Gli è nascosto.

Portuguese Translation - Helmy Nasr

Consultam-te, Muhammad. Dize: Allah vos instrui sobre al-kalãlah. Se um homem morre, não tendo filho nem pai, e tendo irmã a esta, a metade do que ele deixar. E ele a herdará, se ela não tem filho. E, se são duas irmãs, a elas os dois terços do que ele deixar. E, se são irmãos homens e mulheres, ao varão, uma cota igual à de duas varoas. Allah torna evidente, para vós, Suas leis, para que vos não descaminheis. E Allah de todas as cousas, é Onisciente.

Spanish - Noor International

176. Te piden que dictamines (sobre la herencia de quienes mueren sin dejar ni padres ni hijos, oh, Muhammad!). Diles: «Al-lah os decreta (lo siguiente) al respecto: si un hombre muere y no tiene ni hijos (ni padres), pero tiene una hermana (de padre y madre o del mismo padre), esta heredará la mitad de lo que deje. Si la difunta es la hermana y no deja hijos (ni padres), su hermano heredará todo. Si el difunto tiene dos hermanas, estas heredarán dos tercios de lo que deje en herencia; y en el caso de tener hermanos y hermanas, a cada hermano le corresponderá el doble de lo que reciba una hermana[172]. Así aclara Al-lah Sus preceptos para que no os extraviéis. Y Al-lah tiene conocimiento sobre todas las cosas».

English - Sahih International

They request from you a [legal] ruling. Say, "Allah gives you a ruling concerning one having neither descendants nor ascendants [as heirs]." If a man dies, leaving no child but [only] a sister, she will have half of what he left. And he inherits from her if she [dies and] has no child. But if there are two sisters [or more], they will have two-thirds of what he left. If there are both brothers and sisters, the male will have the share of two females. Allah makes clear to you [His law], lest you go astray. And Allah is Knowing of all things.
