Translation — Tafsir
Word Meanings:
- Kalalah (كَلَالَة): A person who dies leaving neither a parent nor a child (i.e., no direct ascendant or descendant heirs).
- Non-harmful will (غَيْرَ مُضَارّ): A will that does not exceed one-third of the estate or otherwise harm the rightful heirs' shares.
Explanation of the Verse:
This noble verse establishes the precise inheritance shares for spouses and for siblings on the mother's side, all within the framework of divine justice and mercy.
First: The Husband's Share of His Wife's Estate:
You, O husbands, are entitled to half of what your wives leave behind if they have no child—whether male or female, from you or from another marriage. However, if they do have a child, your share is reduced to one quarter of what they leave. This is given to you after the execution of any valid will they may have made and the settlement of any debts they owed.
Second: The Wife's Share of Her Husband's Estate:
Your wives are entitled to one quarter of what you leave if you have no child. But if you have a child—whether from them or from another marriage—their share becomes one eighth of what you leave. This applies whether there is one wife or multiple wives, as they share this portion equally among themselves. This is also after the execution of your valid will and the payment of your debts.
Third: The Share of Siblings on the Mother's Side (Kalalah Case):
If a man or a woman dies in a state of *kalalah*—meaning they leave behind no parent and no child—and they have a brother or sister from the same mother, then each such sibling receives one sixth. If there are more than one such sibling, they all share equally in one third of the estate, with no distinction between male and female. This is also after the execution of the deceased's will and the payment of debts, provided the will does not harm the rightful heirs—such as bequeathing more than one third of the estate.
A Divine Command and a Call to Reflection:
This is a commandment from Allah, Who knows what is best for His servants in both this life and the Hereafter. He is All-Knowing of every situation and All-Forbearing, not hastening to punish those who transgress His limits, giving them time to repent and return to Him.
A Da'wah Reflection:
How magnificent is the justice of Islam! In these few lines, Allah has protected the rights of the weak—widows, orphans, and siblings—and established a system that prevents greed and conflict. Imagine a society where every person knows their rights and duties, where wealth is distributed fairly, and where no one is left deprived. This is the beauty of the Qur'anic legislation: it is not merely a set of rules, but a divine mercy that organizes human life with perfect balance. When you reflect on these verses, let your heart fill with gratitude for a Lord who cares for every detail of your life—even after your death. And let this motivate you to learn and implement His laws with love and devotion, for in them lies success in this world and the Hereafter. Allah is indeed All-Knowing of your needs and All-Forbearing in His guidance.
