Word Meanings:
- Al-Qisas (القصاص): Retaliation in kind; the legal principle of exact equivalence in punishment for intentional killing.
- Al-Qatla (القتلى): The slain; those who have been killed.
- 'Ufiya lahu (عُفي له): One who is pardoned; when the guardian of the victim forgives the killer.
- Ad-Diyah (الدية): Blood money; a specified financial compensation paid by the offender in exchange for being pardoned.
- Ittiba' bil-Ma'ruf (اتباع بالمعروف): Demanding compensation in a fair, reasonable, and non-abusive manner.
- Ada' ilayhi bi-Ihsan (أداء إليه بإحسان): Paying the compensation promptly, fully, and with good grace, without delay or reduction.
- I'tada (اعتدى): To transgress; to exceed the limits set by Allah after a settlement has been reached.
Explanation of the Verse:
O you who have truly believed in Allah and followed His Messenger, Allah has prescribed for you the law of just retaliation in cases of intentional murder. This means that the killer is to be dealt with in a manner equivalent to the crime committed, ensuring that justice is served and the sanctity of life is upheld. The principle of equality is clearly established: a free person is executed for killing a free person, a slave for a slave, and a female for a female. This law removes any trace of tribal favoritism or social discrimination, affirming that every life is equally precious in the sight of Allah.
However, the Most Merciful has opened a door of compassion within this framework of justice. If the guardian of the victim—whether the victim himself before death or his heirs after—chooses to pardon the killer, either freely or in exchange for blood money (the diyah), then the matter takes a different course. In such a case, the guardian must demand the compensation in a kind and reasonable manner, without harshness, oppression, or humiliation. Likewise, the killer must pay the due amount promptly and with sincerity, without procrastination, reduction, or ill intent. Both parties are urged to deal with one another in a spirit of brotherhood and mutual respect, for they are connected through the bonds of faith.
This provision of pardon with compensation is a great alleviation from your Lord and a mercy upon this ummah. Previous nations were given stricter laws: for the Children of Israel, retaliation was obligatory with no option for pardon or compensation, while for the Christians, compensation was obligatory with no option for retaliation. But for this community, Allah in His infinite wisdom and grace has granted a choice between the two, making the path of forgiveness easier and more rewarding. This reflects His desire to make matters easy for His servants and to encourage mercy over vengeance.
After this clear legislation and the acceptance of pardon or compensation, whoever transgresses by killing the offender after having forgiven him, or by harming the wrong person, has committed a grave injustice. For such a person, there awaits a painful punishment—either through the application of legal retribution in this world or through the torment of the Fire in the Hereafter. Let every believer take heed: justice is sacred, mercy is noble, and the limits of Allah must never be crossed.
A Call to Reflection and Action:
This verse beautifully balances justice and mercy, two pillars of a healthy society. Islam does not leave the matter of murder to unchecked vengeance, which would breed endless cycles of violence and tribal warfare. Nor does it close the door on forgiveness, which would harden hearts and eliminate the possibility of reconciliation. Rather, it establishes a system that upholds the rights of the victim, disciplines the offender, and preserves the harmony of the community.
Dear believer, see how your Lord cares for you—He legislates what is best for you in every situation. When you are wronged, you have the right to seek justice, but remember that pardoning others for the sake of Allah is a virtue that brings immense reward. The Prophet (peace be upon him) said, "Allah increases a servant in honor when he forgives." And when you are the one who has erred, hasten to make amends sincerely, for Allah loves those who do good.
Let this verse inspire you to be a person of balance—firm in seeking your rights, yet generous in granting forgiveness, always mindful that the ultimate justice belongs to Allah alone. Embrace the mercy of your Lord, and let it transform your relationships with others, for in mercy lies the true strength of a believer.
