Translation — Tafsir
Word Meanings:
- Shahadah (شَهَادَةُ): Testimony or witnessing; here it refers to the formal witnessing of a will.
- Dhawa 'Adl (ذَوَا عَدْلٍ): Two just, upright persons of sound character and integrity.
- Min Ghayrikum (مِنْ غَيْرِكُمْ): From outside your community — i.e., non-Muslims, when necessary.
- Darabtum fi al-ard (ضَرَبْتُمْ فِي الْأَرْضِ): You traveled through the land (a journey).
- Musibah al-mawt (مُصِيبَةُ الْمَوْتِ): The calamity of death — i.e., the approach of death while on that journey.
- Tahbisunahuma (تَحْبِسُونَهُمَا): You detain them — i.e., you hold them back after prayer to take their oath.
- Irtabtum (ارْتَبْتُمْ): You had doubt or suspicion regarding their testimony.
- La nashtari bihi thamanan (لَا نَشْتَرِي بِهِ ثَمَنًا): We do not sell it for a price — i.e., we do not exchange our oath for worldly gain.
- La naktumu shahadata Allah (وَلَا نَكْتُمُ شَهَادَةَ اللَّهِ): We do not conceal the testimony (ordained) by Allah.
Tafsir (Explanation):
O you who have truly believed in Allah and His Messenger and submitted to His commands! When the signs of death approach one of you — whether at home or while traveling — let him formally witness his will before two just and upright Muslims. However, if you are on a journey and the calamity of death befalls you, and no trustworthy Muslims are available, then it is permissible to call upon two non-Muslims as witnesses, provided they are known for honesty and integrity. This is a concession from Allah for times of necessity, showing His mercy and practical wisdom in all circumstances.
If doubt arises about the honesty of these non-Muslim witnesses — for example, if there is reason to suspect they might favor a relative or accept a bribe — then you are commanded to detain them after the prayer, particularly after the afternoon prayer (Asr), a time held sacred by people of all faiths, and make them swear a solemn oath by Allah. In that oath, they must declare: "We will not sell this oath for any worldly price, even if the person in whose favor we testify is our own close relative. We will not conceal the testimony that Allah has commanded us to uphold, for if we did so, we would indeed be among the sinful."
This verse beautifully demonstrates the meticulous care Islam places on justice and the protection of rights, even at the most critical moments of life — the moment of death and the bequest. It teaches us that truthfulness is non-negotiable, that justice must prevail over personal ties and worldly gains, and that even in the most difficult circumstances, Allah provides practical solutions to uphold righteousness. How magnificent is this religion that regulates even the final moments of a person's life with such precision and fairness! It calls us to be people of integrity, whose word is their bond, and whose testimony is a sacred trust before Allah. Let this be a reminder for every believer to always speak the truth, to honor their commitments, and to fear Allah in all their dealings — for indeed, Allah sees and knows all that we do.
