Translation — Tafsir
Word Meanings:
- عُثِرَ (ʿuthira): It means to discover or become aware of something, literally "to stumble upon" a fact.
- اسْتَحَقَّا إِثْمًا (istaḥaqqā ithman): They have committed an act that makes them deserving of sin — i.e., they have been proven guilty of treachery or false testimony.
- يَقُومَانِ مَقَامَهُمَا (yaqūmāni maqāmahumā): Two others take their place — meaning they stand in the position of the two who were found guilty.
- الَّذِينَ اسْتَحَقَّ عَلَيْهِمُ الْأَوْلَيَانِ (alladhīna istaḥaqqa ʿalayhim al-awlayān): Those against whom the first two (the guardians/relatives of the deceased) had claimed the right — i.e., the heirs of the deceased, the closest kin.
- الْأَوْلَيَانِ (al-awlayān): The two nearest relatives (dual form of "awlā" meaning "more entitled" or "closest").
- اعْتَدَيْنَا (iʿtadaynā): We have transgressed or exceeded the bounds of truth and justice.
Tafsir (Explanation):
This verse continues the divine guidance on the sacredness of testimony and oaths, particularly in matters of inheritance and wills. Imagine a situation where two witnesses are called to testify about a will or a debt owed to a deceased person. They take an oath by Allah to affirm their testimony. But then, it becomes evident — through clear evidence or circumstances — that these two have betrayed the trust: they lied in their oath or concealed the truth for personal gain.
In such a case, Allah instructs that two other individuals — from the closest relatives of the deceased, those most entitled to uphold justice on his behalf — should step forward and take the place of the two who betrayed. These two new witnesses must swear by Allah, saying: "Our testimony is more truthful and more deserving of acceptance than their testimony, and we have not transgressed the bounds of justice in what we say. If we were to swear falsely or bear false witness, then indeed we would be among the wrongdoers who have crossed the limits set by Allah."
This ruling is a profound demonstration of Islam's meticulous care for justice. It does not leave the matter of a will or inheritance vulnerable to fraud. When treachery is uncovered, the system corrects itself by replacing the dishonest witnesses with upright ones from the very family of the deceased — those who have the most legitimate interest in preserving the truth. Their oath carries weight because they are not seeking personal gain but rather upholding the right of their deceased relative.
The verse also instills a deep sense of accountability: every oath taken by Allah is a serious matter, and every testimony will be questioned. The believer is reminded that even in worldly disputes, the consciousness of Allah must prevail. If one swears falsely, he is not merely deceiving people — he is counted among the wrongdoers who have transgressed Allah's boundaries. This should make every Muslim pause and reflect: how careful are we with our words, our promises, and our testimonies?
This teaching is a beautiful reflection of Islam's comprehensive justice system — one that protects the rights of the vulnerable, including the deceased, and ensures that truth prevails even in the most delicate of matters. It calls upon us to be people of integrity, to stand for justice even when it is difficult, and to trust that Allah, the All-Seeing, is always aware of what is hidden in hearts.
