Translation Transliteration — An-Nisa
وَاللَّاتِي يَأْتِينَ الْفَاحِشَةَ مِن نِّسَائِكُمْ فَاسْتَشْهِدُوا عَلَيْهِنَّ أَرْبَعَةً مِّنكُمْ ۖ فَإِن شَهِدُوا فَأَمْسِكُوهُنَّ فِي الْبُيُوتِ حَتَّىٰ يَتَوَفَّاهُنَّ الْمَوْتُ أَوْ يَجْعَلَ اللَّهُ لَهُنَّ سَبِيلًا ۝١٥
Wallaatee yaateenal faahishata min nisaaa`ikum fastashhidoo `alaihinna arba`atam minkum fa in shahidoo fa amsikoohunna fil buyooti hatta yatawaffaa hunnal mawtu aw yaj`alal laahu lahunna sabeelaa

Translation — Tafsir

Word Meanings:

  • Al-Fahishah (الْفَاحِشَةَ): The great immoral act, specifically referring to adultery or fornication (zina).
  • Fastashhidu (فَاسْتَشْهِدُوا): Seek testimony or call witnesses.
  • Fa'amsikuhunna (فَأَمْسِكُوهُنَّ): Restrain them, confine them, or keep them in detention.
  • Sabeelan (سَبِيلًا): A way out, a path, or a legal ruling that provides an alternative solution.

Explanation of the Verse:

This noble verse addresses the early Muslim community regarding a grave sin that strikes at the very foundation of family and society — the crime of unlawful sexual intercourse (zina). Allah, the Most Wise, instructs the rulers and judges among the believers that when a woman from among the Muslim women commits this immoral act, they must not rush to judgment based on suspicion or hearsay. Rather, they are required to bring forth four righteous, trustworthy Muslim men as witnesses who have directly observed the act. This stringent requirement serves as a powerful safeguard, protecting the honour and reputation of Muslim women from false accusations and malicious gossip, while also ensuring that such a serious charge is only established with the highest level of certainty.

If the four witnesses do come forward and testify truthfully against her, then the prescribed punishment at that stage of Islamic legislation was to confine her to the home — a form of detention that would last until her death, or until Allah Himself would provide another way out. This was the initial ruling, a temporary measure that carried within it the seeds of divine mercy and gradual legislation.

Indeed, the wisdom behind this progressive approach is profound. Allah, in His infinite mercy, did not leave this matter unresolved. The verse itself hints at a future solution with the words "or Allah makes for them a way out." And true to His promise, Allah later revealed the definitive ruling: the unmarried fornicator is to receive one hundred lashes and be exiled for one year, while the married adulterer is to be stoned to death. This replaced the earlier confinement, providing a clear, just, and comprehensive legal framework.

A Call to Reflect and Reform:

Dear believer, contemplate the beauty of Islamic legislation. It does not seek to punish for the sake of punishment, but to purify society, protect lineage, and uphold dignity. The strict requirement of four witnesses is not a loophole for sinners to escape justice — for Allah knows all that is hidden — but rather a divine mercy that shields the innocent and closes the door to slander and suspicion. Let this verse inspire you to guard your own chastity, to protect the honour of others, and to turn to Allah in sincere repentance for any sin, for He is the Oft-Forgiving, the Most Merciful. The doors of His forgiveness are always open, and His guidance is a light that never dims for those who seek it with a truthful heart.

📜 Verse 13-17 — An-Nisa

13تِلْكَ حُدُودُ اللَّهِ ۚ وَمَن يُطِعِ اللَّهَ وَرَسُولَهُ يُدْخِلْهُ جَنَّاتٍ تَجْرِي مِن تَحْتِهَا الْأَنْهَارُ خَالِدِينَ فِيهَا ۚ وَذَٰلِكَ الْفَوْزُ الْعَظِيمُ
These are the limits [set by] Allah, and whoever obeys Allah and His Messenger will be admitted by Him to gardens [in Paradise] under which rivers flow, abiding eternally therein; and that is the great attainment.
14وَمَن يَعْصِ اللَّهَ وَرَسُولَهُ وَيَتَعَدَّ حُدُودَهُ يُدْخِلْهُ نَارًا خَالِدًا فِيهَا وَلَهُ عَذَابٌ مُّهِينٌ
And whoever disobeys Allah and His Messenger and transgresses His limits - He will put him into the Fire to abide eternally therein, and he will have a humiliating punishment.
15وَاللَّاتِي يَأْتِينَ الْفَاحِشَةَ مِن نِّسَائِكُمْ فَاسْتَشْهِدُوا عَلَيْهِنَّ أَرْبَعَةً مِّنكُمْ ۖ فَإِن شَهِدُوا فَأَمْسِكُوهُنَّ فِي الْبُيُوتِ حَتَّىٰ يَتَوَفَّاهُنَّ الْمَوْتُ أَوْ يَجْعَلَ اللَّهُ لَهُنَّ سَبِيلًا

16وَاللَّذَانِ يَأْتِيَانِهَا مِنكُمْ فَآذُوهُمَا ۖ فَإِن تَابَا وَأَصْلَحَا فَأَعْرِضُوا عَنْهُمَا ۗ إِنَّ اللَّهَ كَانَ تَوَّابًا رَّحِيمًا
And the two who commit it among you, dishonor them both. But if they repent and correct themselves, leave them alone. Indeed, Allah is ever Accepting of repentance and Merciful.
17إِنَّمَا التَّوْبَةُ عَلَى اللَّهِ لِلَّذِينَ يَعْمَلُونَ السُّوءَ بِجَهَالَةٍ ثُمَّ يَتُوبُونَ مِن قَرِيبٍ فَأُولَٰئِكَ يَتُوبُ اللَّهُ عَلَيْهِمْ ۗ وَكَانَ اللَّهُ عَلِيمًا حَكِيمًا
The repentance accepted by Allah is only for those who do wrong in ignorance [or carelessness] and then repent soon after. It is those to whom Allah will turn in forgiveness, and Allah is ever Knowing and Wise.
